Restaurant and Catering Bargaining Councils [BC] in merger discussions

FEDHASA has been made aware of ongoing discussions among the BC for the Food Retail, Restaurant, Catering & Allied Trades, the BC for the Restaurant, Catering & Allied Trades, and the BC for the Fast Food, Restaurant, Catering & Allied Trades regarding the possibility of merging into a single national restaurant, catering, and allied trades bargaining council.

In May 2019, FEDHASA opposed an application by the [partly national] Fast Food, Restaurant, Catering & Allied Trades BC to the Minister of Labour for an extension of the main agreement to non-parties. This opposition ensured that non-members of the council were not, and still are not, obligated to implement and adhere to the conditions of employment set out in the BC agreement.

FEDHASA is not supportive of the idea of a single national restaurant and catering bargaining council and will closely monitor the ongoing discussions. If necessary, the Association will take appropriate action.

The current scope of the three councils is as follows:

  1. Bargaining Council for the Restaurant, Catering, and Allied Trades:
  • Magisterial districts of Alberton, Benoni, Bokburg, Brakpan, Delmas, Germiston, Johannesburg, Kempton Park, Krugersdorp, Randburg, Randfontein, Roodepoort, Springs, and Westonaria.
  • The agreement is extended to non-parties.

2. Bargaining Council for the Food Retail, Restaurant, Catering, and Allied Trades:

  • Magisterial districts of Pretoria, Brits, Bronkhorstspruit, Cullinan, Rustenburg, Warmbaths, Witbank, and Wonderboom.
  • The agreement is extended to non-parties.

3. Bargaining Council for the Fast Food, Restaurant, Catering, and Allied Trades:

  • The Province of Western Cape
  • The Province of Eastern Cape
  • The Province of Northern Cape
  • The Province of Free State
  • The Province of KwaZulu-Natal
  • The Province of North West, excluding the Magisterial Districts of Brits and Rustenburg
  • The Province of Mpumalanga, excluding the Magisterial District of Witbank
  • The Limpopo Province, excluding the Magisterial District of Warmbaths
  • The Magisterial Districts of Heidelberg, Nigel, Vereeniging, Vanderbijlpark, Oberholzer, Meyerton, and Carletonville.
  • The agreement has not been extended to non-parties.
