Employment Equity Act: Draft Employment Equity Regulations 2023 open for public comment

In April this year, the Department of Employment and Labour published an amendment to the Employment Equity Act which contained, amongst others, a provision permitting the Minister to gazette a notice prescribing varying numerical targets for different occupational levels within specified sectors.
The Minster has now gazetted a draft regulation which was published on 12 May for public comment. The document sets out five-year employment equity targets for a number of specified economic sectors including “Accommodation and Food Service Activity” amongst others. Public comment should be made in writing and submitted within 30 days of the 12 May 2023 publication date.
Although the Department has suggested that the legislation is on schedule for implementation by 1 September 2023 this may not necessarily be the case. A lot will depend on the outcome of any court action that might take place and, in addition, the contents of the various written submissions they will receive over the coming weeks.
