Code of Good Practice on the Prevention and Elimination of Harassment in the Workplace – published 18 March 2022

The “Code of Good Practice on the Prevention and Elimination of Harassment in the Workplace” which came into force on the 18th March 202replaces the “Amended Code of Good Practice on the Handling of Sexual Harassment cases in the Workplace” published in August 2005.

The code raises unwanted, repeated and or serious negative conduct in the workplace and describes various types of harassment such as physical, verbal or psychological conduct, threatened violence, various gestures, bullying, insults, negative judgements or criticism, racist or sexist language, emotional abuse and many more.

The code comprehensively includes matters such as sexual harassment and racial, ethnic or social origin harassment and refers to additional statutes that provide one way or another, for the protection of employers and employees in the workplace.

The code provides guidelines for both employers and employees (includes applicants for employment) concerning the prevention and elimination of all forms of harassment in the workplace and defines such activities as unfair discrimination. In addition the code provides for human resource policies, procedures and practises relating to harassment and how best to implement policies that deal with it and prevent reoccurrence.

The overall objective of the code is to create a working environment in which employers and employees respect one another’s integrity, dignity, privacy and right to equality in the workplace.
