The Western Cape Liquor Authority (WCLA) intends implementing section 64 of the Liquor Act this year.
As you may know, this section provides that if the licensee has become disqualified or unfit to hold the licence, has failed to comply with a compliance notice, or has been the subject of a complaint by a municipality during the previous year then the liquor authority may, before the 31st July of that year give the licencee notice that the licence will not be automatically renewed at the end of the year but that he would be compelled to apply in terms of section 64 for the renewal of the licence.
If the application is successful, the licence will be renewed for the following year. If the application fails the licence will lapse immediately or upon a date determined by the Liquor Licenceing Tribunal.
We have been informed that the WCLA will during July of this year send out notices giving the licencees concerned notice to apply for the renewal of their licences by the 30th September 2022.
